Terms of Service

These Terms of Service are provided in English. The English version is the legally controlling version. A summary in Spanish is provided at the end of this document. / Estos Términos de Servicio se proporcionan en inglés. La versión en inglés es la versión legalmente vinculante.

Important: By using our website or requesting any service from El Salvador VIP, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, do not use our services.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and El Salvador VIP ("Company," "we," "our," or "us") governing your access to and use of our website at elsalvadorvip.com and our luxury ground transportation services in El Salvador.

By accessing our website, submitting a booking request, communicating with us via WhatsApp or email, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using our services on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms, in which case "you" and "your" shall refer to that entity.

2. Our Services

2.1 Service Description

El Salvador VIP provides premium ground transportation services in the Republic of El Salvador, including but not limited to:

  • Airport transfers (arrival and departure)
  • Hourly chauffeur service
  • Corporate and executive transportation
  • Event and occasion transportation (weddings, galas, quinceañeras, etc.)
  • Private day trips and point-to-point transportation
  • Long-distance travel within El Salvador

2.2 Geographic Scope

Our services operate exclusively within the territory of El Salvador. We do not provide international transportation across national borders.

2.3 Service Availability

We operate 24 hours a day, 7 days a week, 365 days a year, including all holidays. Availability is subject to vehicle and chauffeur availability at the time of booking. We reserve the right to limit service availability in exceptional circumstances beyond our control.

2.4 Vehicle and Chauffeur Assignment

We reserve the right to assign any qualified chauffeur and available vehicle from our fleet to fulfill your booking, subject to any specific vehicle type agreed upon at the time of booking confirmation.

3. Booking & Reservations

3.1 How to Book

Bookings may be made through the following channels:

  • Our website booking form (which redirects to WhatsApp)
  • Direct WhatsApp message to +503 6680 7388

3.2 Booking Confirmation

A booking is confirmed only when we have sent you written confirmation of the details via WhatsApp or email. Until you receive written confirmation, no binding agreement for a specific trip exists. We reserve the right to decline any booking request at our sole discretion.

3.3 Accuracy of Information

You are responsible for providing accurate and complete booking information, including:

  • Correct pickup location and destination
  • Accurate date and time requirements
  • Correct number of passengers and luggage
  • Accurate flight information for airport transfers
  • Any special requirements or instructions

We are not responsible for service failures or additional costs arising from inaccurate information you have provided. Additional charges may apply if the actual requirements differ materially from what was booked.

3.4 Advance Booking

We recommend booking at least 24 hours in advance to ensure availability. For large events or multi-vehicle bookings, we recommend 48 hours or more. While we will make every effort to accommodate last-minute requests, we cannot guarantee availability for requests made less than 24 hours in advance.

4. Pricing & Payment

4.1 Pricing

Our pricing is provided upon request and confirmed at the time of booking. All quoted prices are in United States Dollars (USD) unless otherwise specified. Prices are all-inclusive and cover standard taxes, tolls, and operational costs, unless additional charges are specifically disclosed at the time of booking.

4.2 No Hidden Fees

We are committed to transparent pricing. You will not be charged amounts beyond the agreed price unless you request additional services, destinations, or waiting time beyond the booked period, or unless extraordinary circumstances arise (such as government-imposed charges or last-minute itinerary changes at your request).

4.3 Payment Methods

We accept the following payment methods:

  • Cash (United States Dollars)
  • Credit and debit cards
  • Zelle (where applicable)
  • Other payment arrangements for ongoing corporate accounts (to be agreed upon separately)

Payment terms will be confirmed at the time of booking. For corporate accounts, invoicing arrangements may be established by separate written agreement.

4.4 Additional Charges

The following may result in additional charges, which will be communicated to you before or at the time they arise:

  • Waiting time beyond the standard grace period (typically 15 minutes for regular pickups; up to 60 minutes for airport arrivals after landing)
  • Additional stops or route changes not included in the original booking
  • Extended service hours beyond the agreed booking period
  • Cleaning fees for vehicles requiring extra cleaning due to client actions

5. Cancellation & Modification Policy

5.1 Cancellation by Client

  • More than 24 hours before scheduled pickup: Full refund or no charge if payment has not yet been collected.
  • Less than 24 hours before scheduled pickup: A cancellation fee of up to 50% of the agreed fare may apply, at our discretion.
  • No-show (client does not appear at pickup location): The full fare may be charged.

Cancellations must be communicated via WhatsApp or email. Verbal cancellations are not accepted unless confirmed in writing.

5.2 Cancellation by El Salvador VIP

We reserve the right to cancel a booking in exceptional circumstances, including force majeure events, vehicle breakdown, safety concerns, or if you have breached these Terms. In the event we cancel through no fault of yours, you will receive a full refund of any amounts paid. We will provide as much advance notice as possible.

5.3 Modifications

You may request modifications to confirmed bookings (such as changes to pickup time, location, or destination) via WhatsApp or email. Modifications are subject to availability and may affect pricing. We will confirm any modification and any pricing adjustments in writing.

5.4 Flight Delays

For airport transfer bookings, we monitor flight status and will adjust your pickup time accordingly at no additional charge for delays within the scope of normal airline operations. For extended delays beyond our waiting period, we will use reasonable efforts to accommodate you and will communicate any additional charges that may apply.

6. Client Responsibilities

6.1 Conduct in the Vehicle

You and all passengers in your party are responsible for:

  • Treating the chauffeur and vehicle with respect
  • Not engaging in any conduct that endangers the safety of the chauffeur or other passengers
  • Not consuming alcohol or illegal substances in the vehicle unless expressly permitted by us in advance
  • Not smoking or vaping in the vehicle
  • Using seatbelts at all times while the vehicle is in motion
  • Not interfering with or distracting the chauffeur while the vehicle is in motion

6.2 Punctuality

You are responsible for being ready at the agreed pickup time and location. While we accommodate reasonable delays (particularly for airport arrivals), excessive waiting may result in additional charges or cancellation of the booking at our discretion.

6.3 Luggage and Personal Property

You are responsible for your personal property at all times. We exercise reasonable care with luggage, but we are not responsible for loss, theft, or damage to personal property unless caused by our proven negligence.

6.4 Damage to Vehicle

You are responsible for any damage to our vehicles caused by you or members of your party beyond normal wear and tear. This includes, but is not limited to, staining, soiling, or any damage requiring repair. We reserve the right to charge you for the full cost of repair, cleaning, and any loss of revenue during the repair period.

7. Our Responsibilities & Service Commitments

7.1 Professional Service

We commit to providing ground transportation services with professional, licensed, and vetted chauffeurs operating clean, well-maintained premium vehicles.

7.2 Punctuality

We commit to having your chauffeur at the agreed pickup location at or before the agreed pickup time. In the rare event of unforeseen delays on our part, we will contact you immediately with an updated estimated arrival time.

7.3 Safety

We maintain all vehicles to applicable safety standards and ensure our chauffeurs hold valid licenses and operate within applicable traffic laws.

7.4 Confidentiality

We treat all client information, travel details, and conversations with complete confidentiality. Our chauffeurs are trained to maintain the privacy of all passengers.

8. Limitation of Liability

8.1 General Limitation

To the fullest extent permitted by applicable law, El Salvador VIP's total liability to you for any claim arising from or related to these Terms or our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.

8.2 Exclusion of Consequential Damages

To the fullest extent permitted by applicable law, El Salvador VIP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of business, loss of data, or loss of opportunity, even if we have been advised of the possibility of such damages.

8.3 Force Majeure

We shall not be liable for any failure or delay in providing services caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, extreme weather, civil unrest, government actions, traffic accidents caused by third parties, road closures, pandemics, or any other event beyond our reasonable control. In such cases, we will provide as much advance notice as possible and work with you to reschedule or find an alternative solution.

8.4 Third-Party Services

We are not responsible for any acts or omissions of third parties, including airlines, hotels, event venues, or any other third-party service provider involved in your travel.

8.5 Applicable Law Limitations

Nothing in these Terms limits our liability where such limitation is prohibited by applicable law, including where liability cannot be excluded under the laws of California (for California residents) or applicable EU consumer protection law (for EU residents).

9. Prohibited Conduct

You agree not to use our services or website for any of the following:

  • Any unlawful purpose or in violation of any applicable laws or regulations
  • Transporting illegal goods, substances, or contraband
  • Any activity that endangers the safety of the chauffeur, other passengers, or third parties
  • Providing false or misleading information in connection with a booking
  • Attempting to access systems or data not authorized for your use
  • Any activity that could damage, disable, or impair our website or services
  • Harassment, abuse, or threatening behavior toward our staff or chauffeurs

We reserve the right to terminate a service in progress, refuse future bookings, and report conduct to law enforcement authorities if you engage in any prohibited conduct.

10. Intellectual Property

All content on our website, including but not limited to text, images, logos, graphics, and software, is owned by or licensed to El Salvador VIP and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any of our content without our prior written consent.

You retain ownership of any information you submit to us. By submitting information for the purpose of booking a service, you grant us a limited license to use that information solely to provide the requested service.

11. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the processing of your information as described in our Privacy Policy.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of El Salvador, without regard to its conflict of law principles.

For California Residents: Nothing in this section waives any rights you have under California law that cannot be waived by contract, including your rights under the California Consumer Privacy Act (CCPA/CPRA) or applicable California consumer protection statutes.

For EU/EEA Residents: If you are a consumer residing in the European Union or European Economic Area, you retain the rights afforded to you under applicable EU consumer protection legislation, including Regulation (EU) 2016/679 (GDPR) and applicable national consumer law. Nothing in these Terms limits those rights.

13. Dispute Resolution

13.1 Informal Resolution

In the event of any dispute, claim, or controversy arising from or related to these Terms or our services, we encourage you to first contact us directly at hello@elsalvadorvip.com to seek an informal resolution. We will make a good-faith effort to resolve any dispute informally within 30 days of your written notice.

13.2 Governing Jurisdiction

If the dispute cannot be resolved informally, you and El Salvador VIP agree to submit to the exclusive jurisdiction of the competent courts of the Republic of El Salvador for any dispute arising from these Terms or our services, subject to the exceptions in Section 12 for California and EU/EEA residents.

13.3 Consumer Rights Exceptions

Nothing in this Section prevents you from pursuing remedies available to you under applicable consumer protection laws in your jurisdiction, including the right to contact local consumer protection authorities or data protection authorities.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this page. For significant changes, we may provide additional notice on our website.

Your continued use of our website or services after any update to these Terms constitutes your acceptance of the revised Terms. If you do not agree with any modification, you must stop using our services.
